Bookings and payments
Bookings become binding once you accept our written proposal and pay the specified deposit, or otherwise agree in writing. Deposit amounts and deadlines appear on the proposal and vary by program type. Final payment terms are included with each itinerary, typically due 60 days before departure for scheduled small-group journeys. For custom or research programs we may require staged payments; these will be documented in the proposal. Payments are processed through secure third-party payment providers. You must ensure that billing information is correct and that you have authority to make payments from the card or account used. Any additional costs incurred during travel, such as optional activities, personal purchases, supplements for last-minute changes, or penalties imposed by suppliers, remain the responsibility of the traveller unless otherwise agreed in writing.
Cancellations and refunds
Cancellation terms balance fairness to clients and commitments we make to local partners. If you cancel a confirmed booking, cancellation fees apply based on the notice period specified in the proposal. For group departures, published schedules indicate the cut-off for full refunds and when deposits become non-refundable. Where we cancel a trip due to insufficient bookings, we will offer alternatives or full refunds where alternatives are not agreed. Refunds are issued through the original payment channel within a reasonable period, subject to processing times of financial institutions. Force majeure events - such as extreme weather, strikes, official travel restrictions, pandemics or other events beyond our control - may require cancellation or changes. In such cases, we will offer alternatives, credits or refunds according to supplier policies and any applicable law. We recommend travellers hold appropriate travel insurance that covers cancellation and interruption risks, as our liability for such events is limited.
Liability and insurance
Our role is as organiser and facilitator for travel services. We contract with local suppliers - guides, transport operators, accommodation providers and others - and endeavour to select reputable partners. However, we cannot accept liability for the acts or omissions of independent suppliers beyond our direct control. To the fullest extent permitted by law, our liability for loss, damage or injury is limited to the total amount paid for the booking. Travellers must carry suitable travel and medical insurance that covers personal injury, medical evacuation, repatriation and property loss. It is the traveller's responsibility to disclose any health conditions or mobility limitations that may affect participation. Where a traveller's condition presents a safety risk to themselves or the group, we reserve the right to modify arrangements or exclude the traveller from activities to protect health and safety, in which case standard cancellation terms may apply.
Intellectual property and content use
All content on our website, including text, photographs and designs, is owned or licensed by Incredible India Journeys and is protected by copyright. You may not reproduce, distribute or create derivative works from this content without our express written permission. Where guests or contributors supply images or written material for publication, rights and credits will be agreed before use. We welcome non-commercial sharing of editorial pieces with clear attribution and a link to the original page. Use of our trademarks, logos or brand assets requires prior written consent. Guests may be photographed during trips; we will seek consent for identifiable images and note any restrictions requested. Please contact us if you wish to request permission to use our materials for commercial or editorial projects.
Governing law and dispute resolution
These terms are governed by the laws of India, and any dispute relating to our services or these terms will be subject to the exclusive jurisdiction of the courts in New Delhi, unless the parties agree otherwise. We aim to resolve issues amicably and encourage you to contact our office promptly if a problem arises so we can seek an early resolution. For consumers in jurisdictions that grant mandatory protection beyond the limits in these terms, those statutory rights will apply in addition to these terms to the extent required by law.
Amendments and contact
We may update these Terms of Service from time to time. Material changes that affect existing bookings will not be applied retrospectively to confirmed bookings unless required by law, and we will communicate relevant updates where necessary.
